New laws are set to come into force on December 1, 2017 that will impact landlords and tenants with the introduction of the Private Housing (Tenancies) (Scotland) Act 2016. It aims to provide increased clarity and security for both landlords and tenants, with appropriate safeguards for lenders and investors. Applicable to all new tenancies beginning on or after December 1 (existing short assured and assured tenancies will continue), the new rules include tighter restrictions for landlords on ending a lease; rent increases no more than once a year; an end to fixed or end dates for leases (new tenancies are open-ended); changes to pretenancy information and documentation supplied to tenants; and new appeal and arbitration procedures.
